Actually, no. Various jurisdictions recognise patents and other kinds of 
intellectual property in plant varieties (or the plant genome).

This is actually one of the evils of GE - accidentally have your pollinated 
with Monsanto's patented modified stock, and have Monsanto sue or demand that 
your seed be destroyed.
