Strictly speaking, you are right.  This is one reason that the
European system of justice doesn't suck as much as ours; they place
less weight on precedent, which one rogue judge can create early in a
law's existence, and more on the wording of the law.

But, despite the fact that the law can be an ass, the opinion of the
folks who drafted the license (GNU) carries a fair amount of weight, I
should think.
