I suspect that a really important part of the process will be to *prove*
that the owner of a machine had *never* run Windows on it at all - from
the article, the guy provided photo evidence of not accepting the EULA.
If you *even once* ran the included Windows, you would probably, and
fairly, lose rights to redress. Just deciding later that you didn't want
it isn't enough.
Perhaps when placing an order it would be a good idea to add extra
commentry saying that you don't want Windows to be provided in the first
place; that way it's recorded somewhere independant of your own
testimony.
