I read the story of a fellow in the US who managed this.

He bought a pre-loaded system from a company that also sold Windows by
itself.  He didn't do the startup (which completes loading Windows), but
requested a refund, per the MS license agreement.

The retailer had to be reminded that the agreement was a contract they
must honor, but offered a similar amount.  He then ordered 10 copies of
Windows from them at that price, and they refused - they quoted the
retail price.

So he claimed in court with this information and the judge ruled in his
favor.  The supplier rebated the retail Windows price.

With a judgement in favor, a claim for expenses would also likely be
granted.

I have not done this.  I am using the Windows on my tablet (Just for the
text recognition libraries - I  boot Xubuntu).
