Dear Mr Templeman
Thank you for your email dated 25 February 2005 regarding Telstra Clear
de-peering from the Wellington Internet Exchange (“WIX”).

The Commerce Commission is currently monitoring many aspects under the
Telecommunications Act including the New Zealand peering situation.

The Commission can commence an investigation into issues of this kind
under the Telecommunications Act and make recommendations to the
Minister of Communications based on the outcome of the investigation.

At this stage, the Commission does not consider that there are grounds
for commencing such an investigation. However, we will continue to
monitor the situation.

Thank you again for the information you have provided. As well as
carrying out our own surveillance, the Commission relies on receiving
information from consumers and businesses to identify potential breaches
of the law. Please contact us again, should you come across further
peering issues.
