There is no other case law I am aware of, so I would have thought that
even though this is a German case, it is likely to carry some weight
in common law jurisdictions (US/UK/Aus/NZ).

In short, a person would stand to lose a lot by not complying, and it
seems fairly obvious that any attempt not to comply would be weasling
around the intent of the GPL.  What would a person lose by complying
and providing source?
