if DSE produced the CD then yes.
if the box has been produced by mandrake, then it's reasonable to assume
that mandrake won't push their responisbility to DSE because it will
only make it harder for them to get DSE to keep selling mandrake.

not unless they can assure that the mandrake mirror is identical and
valid for 3 years.
in practice this does not become an issue unless there are modifications
involved. but if a distributor wants to play it safe, better stick to
the rules.
the safest way is always to just include the source.
